The Port of Grays Harbor Commission Meeting for July 14, 2009 was called to order at 9:04 a.m.

Mike Johnson led the meeting in the Pledge of Allegiance.

MINUTES:
1. By motion made by Commissioner Thompson, seconded by Commissioner Pinnick and approved, the Commission adopted the Minutes of the June 9, 2009, Regular Commission Meeting as recorded in Minutes Book No. 16, on pages 205 through 209 inclusive.

VOUCHERS:
1. By motion made by Commissioner Thompson, seconded by Commissioner Pinnick and adopted, the Commission approved for payment those Payroll Vouchers issued June 19, 2009 and July 2, 2009, and General Disbursement Vouchers No. 73505 through and including No. 73673 for payment in the amount of $557,134.17.

Commission President Pinnick excused the absence of Commissioner Caldwell from the meeting.

REPORTS:
Westport Art Festival
Art Festival Committee Member Joan Huisinga briefly reported on the festivities planned for 12th Annual Westport Art Festival set for August 15 and 16. Ms. Huisinga thanked the Port for their continued support as a sponsor in allowing use of the marina garbage dumpster for event trash.

Westhaven Drive Reconstruction Project
City of Westport Administrator Randy Lewis outlined the upcoming project along Westhaven Drive. Construction is scheduled to begin in late-September and will involve closure of Westhaven Drive from Dock Street to Cove Street for approximately two months to accomplish the work. Improvements will include a new asphalt surface, bulb outs and stamped crosswalks at the intersections, a one-way traffic pattern, bicycle lane, conduit for future pedestrian lighting, and drainage improvements.

Two of the main impacts to the Port will be the loss of approximately five parking spaces at the observation tower at the northwest end of Westhaven Drive and the temporary closure of the roadway during construction. Emergency vehicle traffic access will be maintained, as well as scheduled delivery traffic. The closure will not affect access to the Main Dock and pedestrian traffic will be maintained to all businesses and floats in the area.

R&D/Incubator Facility Update
Mary Nelson updated the Commission on the status of the proposed facility and its funding, including $1 million from the State for the Grays Harbor Innovation Partnership Zone, and an SBA grant award of $427,500, thanks to the work of Senator Patty Murray. As part of the acceptance of the federal grant, an application to the Small Business Administration was submitted on July 2.

Since the original feasibility study, that talked about a 20,000 square-foot building with half of the facility dedicated to lab space costing an estimated $4.5 million, Port staff has been evaluating a phased approach to the project. Paneltech’s Roy Nott spoke briefly on the importance of the facility to the future of their company.

Terminal 3 Dock Enhancements
Mike Johnson reported on proposed upgrades to the Terminal 3 Dock that will add extra strength to the existing fender system and allow for proper movement of barges while loading chips. Additional dolphins and corner protection on the west end of the pier are being considered for this upgrade. Berger/ABAM is working on design and sizing of mooring dolphins and a removable camel system. As soon as permits have been secured, bids will be requested from contractors from the Port’s Small Works Roster to install the new components.

Pilot Boat Maintenance
Mike Johnson provided a PowerPoint presentation outlining scheduled annual hull maintenance inspection and repairs on the Port’s Pilot Boat Chehalis. Quotes for the work were requested from five companies, with only one response received from The Shipyard in Hoquiam. While the vessel is in dry-dock for almost a month, pilots will be delivered to/from ships by either a Knutson Towboat tug or a helicopter out of Astoria, as weather permits.

Vessel Activity
Leonard Barnes reported the Port loaded 72,112 MT of commodities aboard four vessels during June: 2 AGP, a log ship and a ro-ro vessel. Year-to-date, the Port has loaded/unloaded twenty vessels with 337,290 MT of cargo.


Public Comment
Melissa Montgomery of the Washington State Department of Natural Resources (DNR) thanked the Port for their assistance by providing temporary dockage to DNR of the seized vessel Northern Retriever. The boat has been towed to Puget Sound and is in the process of being dismantled and scrapped.

ACTION/RESOLUTION ITEMS:

Robin Leraas presented a proposed schedule of daily and monthly transient moorage fees for the Westport Marina. The current rates have been in effect since 1992 and no longer reflect the actual costs associated with operating and maintaining the marina, nor do they address the current market conditions for similar marina facilities.

President Pinnick declared a 5-minute recess at 10:07 a.m.

The meeting was called back to order at 10:12 a.m. by President Pinnick.

Motion to Amend the Westport Marina Tariff No. 58-A by revising the Marina’s daily transient moorage rates as proposed effective August 1, 2009 was made by Commissioner Thompson and seconded by Commissioner Pinnick. Motion passed with all Commissioners present in favor.

It was agreed that the Commission would revisit the monthly transient rate proposal in August for later implementation consideration.

Resolution 2743
Vicki Cummings, Executive Director of the Grays Harbor Council of Governments, presented the Port’s Six-Year Transportation Improvement Program for 2010 to 2015 (TIP) to the Commission for consideration. In order to secure state and federal funding for transportation projects, a public entity must have such projects included in a 6-Year TIP, adopted and updated annually.

Motion to adopt Resolution No. 2743: Adoption of the Port of Grays Harbor Six Year Transportation Improvement Program 2010-2015 was made by Commissioner Thompson and seconded by Commissioner Pinnick. Motion passed with all Commissioners present in favor. Resolution Adopted.

Resolution 2744
Mike Johnson reported that Fence Specialists, Inc. has completed installation of Marine Terminal Security Fencing under Contract No. 1581. The contract called for installation of 10,463 lineal feet of perimeter fencing and gates around the Port’s Main Marine Terminal Complex. Funding for the project came from the U.S. Department of Homeland Security’s FY07 Port Security Grant Program with the Port providing the local match.
Motion to adopt Resolution No. 2744: Completion and Acceptance of Contract No. 1581, Marine Terminal Security Fencing was made by Commissioner Thompson and seconded by Commissioner Pinnick. Motion passed with all Commissioners present in favor. Resolution adopted.

Resolution 2745
Mike Johnson announced that Campbell Electric Company, Inc. has completed electrical repairs at Terminal No. 3. The project included installation of new equipment and repairing parts of the existing system supplying power to the T3 dock office and dock lights.

Motion to adopt Resolution No. 2745: Completion and Acceptance of Contract No. 1585, T-3 Electrical Repair was made by Commissioner Thompson and seconded by Commissioner Pinnick. Motion passed with all Commissioners present in favor. Resolution adopted.

Resolution 2746
Robin Leraas described the process the Marina has pursued to collect charges due on two vessels. The vessels were seized for nonpayment of charges per RCW 53.08.320. A Public Auction is being scheduled for the sale of the abandoned vessels.

Motion to adopt Resolution No. 2746: Authorization to Sell Abandoned Vessels was made by Commissioner Thompson and seconded by Commissioner Pinnick. Motion passed with all Commissioners present in favor. Resolution adopted.


Public Comment
Brian Pernula, Wild West Seafood, Olympia – Mr. Pernula requested an update of the Westport Marina public hoist issue be provided at the August Commission Meeting.

NEW BUSINESS:
Josh Metcalf of HDR Engineering briefly reported on the Port Industrial Road Improvement Project. Environmental documentation has received federal approval. The Project is just awaiting authorization of federal funds release before the contract can go out to bid. This release is expected shortly. It is anticipated that a Special Commission Meeting will be necessary after bids are due, but before the next Regular Commission Meeting to award the contract in order to avoid delaying construction.

Lisa Benn reported that the Hydraulic Project Approval (HPA) has been issued by the Washington Dept. of Fish & Wildlife on the Westport Boat Haul-Out Facility. The final biological evaluation incorporating the HPA language and accepted mitigation plan has been submitted to the U.S. Army Corps of Engineers and other federal permitting agencies. All clarifying questions from the federal agencies have been addressed and indication is that federal approval of the project will be forthcoming.

Gary Nelson stated that WSDOT has a pontoon construction meeting scheduled for July 16.

Leonard Barnes announced that the Grays Harbor Shipping Club will host a golf tournament and barbeque at the Grays Harbor Country Club on August 11.

There being no further business to come before the Commission, the Regular Meeting recessed at 10:33 a.m.

The Board then went into Executive Session to consider the sale or lease of real property and discuss with legal counsel potential or actual litigation. No action to be taken during Executive Session. It was announced that the Executive Session would last two hours.

The Executive Session ended at 12:30 p.m. and the Regular Meeting adjourned at that time.
